I’ve Been Assaulted at Work – What Are My Options?

Each year, millions of workers across the country are the victims of workplace violence. Assaults on employees can happen on company property, off-site locations, and at other business-related activities. Oftentimes, work place assaults are directed toward the head and face of the victim. Soft-tissue injuries like bruising, cuts, black eyes and swelling are often associated with this type of assault. However, more serious injuries can occur as well, including concussions, fractured or broken bones, deep gashes, or herniated disks. If the assault is particularly violent, the injuries sustained by the victim might even be life-threatening.

Workers’ Compensation for Victims of Workplace Assault

An employee injured in a workplace assault can try to collect workers’ compensation benefits. This can include restitution for medical or therapy costs, out-of-pocket expenses, and lost wages from missed work after the assault. If you’ve been assaulted by a coworker, you will need to file a report of the injury with your employer in order to begin your claim.

If you feel you may need further treatment, you should ask your employer for a list of company-approved physicians. The one you choose will become your primary treating physician. If you feel your physician isn’t acting in good faith, or that your injury is more serious than they think, you may request a second opinion from another company-approved physician.

You will need to be able to show that the assault happened while you were at work or performing job-related duties. This will require proof that the motivation for the assault was, in fact, work-related and not purely personal. You likely won’t receive compensation if you were the instigator/aggressor of a physical altercation.
